Terms of Service: Guiding Principles for Optimal User Engagement

2. Services/Products:

SamPhaTao Tour offers mediation, sales, and organization services for tours, activities, tickets, and attractions in Thailand, with a focus on the islands of Koh Samui, Koh Phangan, and Koh Tao.

3. Terms of Use:

The services may be utilized by any individual of legal age, including accompanying children.
Usage is subject to the terms and conditions outlined herein.
Any unlawful actions or violations of the terms are prohibited.

4. Registration and Account Access:

Registration is required for the use of certain services.
Data is stored solely for the fulfillment of business activities and services.

5. Prices and Payment Terms:

Accepted payment methods: Cash payments, Credit cards, debit cards, Apple Pay, Google Pay.
Payment is due upon booking; no additional fees (Credit cards, debit cards, Apple Pay, Google Pay).
Cash Payments must be paid no later than 72 Hours before scheduled activity / tour / excursion / rental / transfer date at Smile@Samui Travel, Chaweng OR at SamPhaTao Tour, Lamai with the order number received by mail. Cash Payments are nonrefundable.
Cancellation (Credit cards, debit cards, Apple Pay, Google Pay) is permitted up to three days (72 hours) before the scheduled activity / tour / excursion / rental / transfer with a 10% transaction fee deducted from the total amount paid and an extra 1500THB administration cost. (Example: TOTAL - 10% - 1500 THB = REFUND)
Changes made up to 3 days (72 hours) before the booked activity / tour / excursion / rental / transfer are subject to a 1500THB administration fee in addition to the total amount paid, plus any additional expenses incurred as a result of the changes. (Example: TOTAL + 1500 THB + Changed Tour = NEW TOTAL)
Cancellations, no-shows, or changes made within 3 days (72 hours) of the booked activity / tour / excursion / rental / transfer and the confirmed time and date are not permitted under any circumstances or for any reason and are strictly nonrefundable.
Weather-related cancellations by tour operators or the marine police can be RESCHEDULED ONCE or may be refunded free of charge, minus 10% transaction fee.

5.1. Cancellation and Payment Policy Addendum for Private Luxury Catamaran Charter:

In addition to the general Terms of Service, the following conditions apply specifically to cancellations and payments for private luxury catamaran charters:

Payment by Cash:

A 50% deposit is required at latest within 24 Hours after the time of booking. Failing to do so, cancels the booking automatically.
The remaining 50% balance must be paid no later than 7 days before the scheduled charter date.

Cancellation Policy:

Cancellations made less than 15 days before the scheduled charter date, the 50% booking deposit will not be refunded.
Failure to pay the 50% balance at least 7 days before the scheduled charter date will be considered a cancellation. In such cases, the 50% booking deposit will not be refunded.
Cancellations within 7 days before the scheduled charter date, the entire charter payment will not be refunded.

These conditions are implemented to ensure the smooth operation of our luxury catamaran charters and to compensate for any loss incurred due to late cancellations. Please carefully review and acknowledge these terms prior to confirming your private luxury catamaran charter booking.

6. Intellectual Property:

All rights to intellectual property, including copyrights, trademarks, and patents, remain with SamPhaTao Tour.

7. Privacy and Data Protection Policies:

Personal data is collected and used solely for website analysis and the fulfillment of services.
Use of cookies and other tracking technologies, including Google AdSense, Facebook Pixel and other common analysis tools, with an emphasis on data reduction.

8. Disclaimers and Warranties:

Insurance: SamPhaTao Tour and every tour booked from us is insured as required under Thai law. Each service is also insured by the provider of the tour or activity.
Pickup Times: Pickup times are approximate and may be affected by local traffic conditions. Please be ready at the designated pickup point on time.
Responsibility for Arrival: If your accommodation is located on elevated terrain (e.g. Hillside, Mountain), it is your responsibility to arrive at the specified meeting point closest to your location provided by us.
Changes to Itinerary: We reserve the right to make changes to the itinerary due to unforeseen circumstances. Any major changes will be communicated to you promptly.
Participant Requirements: Participants must adhere to all safety guidelines and requirements during the activity. Failure to comply may result in exclusion from the tour without a refund.
Weather Conditions: Some activities are weather-dependent. In case of unfavorable conditions, alternative arrangements will be made, or a refund may be offered.
Health and Safety: Participants with pre-existing health conditions are advised to consult with a medical professional before booking. Inform us of any health concerns beforehand.
Liability: We are not liable for any loss, damage, or injury sustained during the activity, except in cases of proven negligence on our part.

9. Jurisdiction and Venue:

Thai jurisdiction applies to legal disputes, Koh Samui, Suratthani, Thailand.

10. Changes to the Terms and Conditions:

SamPhaTao Tour reserves the right to amend these terms and conditions.
Users will be notified of changes in a timely manner.
